A legal question regarding divorce and student loans?

Hi,
I unfortunately refinanced students loan with the ex husband. My loan was approx. $2000 and his awesome was for $97,000. We divorced in 07 anf the husband did accept spend the money for student loans in the divorce papers. He’s since gotten near default twice, and says he “just doesn’t want to cover them.” Exactly what can I actually do. He’ll almost certainly not assist me to by any means to refinance my name off of them. He says he basically doesn’t care if its ruining my credit and it is my problem so I should decipher it out.
If I sue him for breach with the divorce contract, still does not mean he’ll pay. Can one sue each student loan provider to look at me off?
Mind you, he’s an attorney. Yeah! That was sarcastic. Any help totally appreciated.

Wow! Thanks for the quick responses. This is exactly what I have been previously told, since they are figuratively speaking they can’t be separated. I’m wondering has anyone successfully got their name of an exes student loan?
Company, back in time can be awesome, but unlikely.

Maybe you have talked to the lending company which you refinanced the loans through and shown them the divorce papers where it says which he agrees to pay for the loans? When it is developed in a legally binding contract, then he must pay them. I would sue him for breach as well as fight to obtain your name removed from of the original documentation from the bank.

I really doubt each student lender is going to take your business off. However you could call and ask. As well as the court doesn’t have jurisdiction them over.

I think you are going to ought to hire an attorney.

    well i would take his attorney @ss to court. the court should have had your name removed from the loan. so i would take him to court and
    have my name removed he has the money and he can have fun
    paying his bill. don’t let him destroy your good credit.

    Call the company who’s holding the loan. When I divorced, all I had to do was provide a copy of the divorce decree showing that he had accepted legal responsibility.

    If it is in the divorce, you should be able to have that shown to the company and have it seperated most likely.
